अनुबंध (Agreement) शब्द हमें अक्सर सुनाई पड़ता रहता है। म्युचअल एग्रीमेंट (Mutual Agreement), रेंट एग्रीमेंट (Rent Agreement), लोन एग्रीमेंट (Loan Agreement) और एग्रीमेंट फॉर इंटर्नशिप Agreement for Internship) जैसे तमाम एग्रीमेंट आज की आवश्यकता हो गए हैं। आज के इस लेख के माध्यम से हम अनुबंध (Agreement) के बारे में प्राप्त करते हैं महत्त्वपूर्ण जानकारी, जिसमें शामिल है:

1. अनुबंध (Agreement) क्या होते हैं?

अनुबंध (Agreements) साधारणतया ऐसे लिखे हुए दस्तावेज होते हैं, जो कि अनुबंध के पक्षकारों (Parties) के बीच लिखे जाते हैं।

2. अनुबंध (Agreement) कैसे तैयार किये जाते हैं तथा किन बिंदुओं का ध्यान रखना चाहिए?

अनुबंध में प्रतिफल की महत्त्वपूर्ण भूमिका होती है। प्रतिफल का मतलब हुआ कि किसी वस्तु के बदले में मिलने वाला धन। अनुबंध के लिए दी गयी सहमति स्वतन्त्र होनी चाहिए। अनुबंध करने के लिए व्यक्ति का सक्षम होना बहुत आवश्यक होता है। अनुबंध के लिए व्यक्ति का व्यस्क होना अति आवश्यक है। वैध अनुबंध के लिए अनुबंध का लिखित में होना अति आवश्यक है।

अनुबंधों को तैयार करने में सबसे अधिक ध्यान देने वाली बात यह है कि इसमें पक्षकारों के उद्देश्य स्पष्ट रूप से व्यक्त किये जाने चाहिए, जिससे भविष्य में किसी प्रकार के वाद-विवाद का प्रश्न न उठे। अनुबंधों को ड्राफ्ट करते समय सरल और निश्चित व स्पष्ट अभिप्राय वाले शब्दों का प्रयोग किया जाना चाहिए। अनुबंध तैयार करते समय सबसे ऊपर शीर्षक लिखें तथा उसके नीचे दोनों पक्षकारों के नाम, उम्र व पता को लिखें। तत्पश्चात जिस प्रयोजन से अनुबंध बनाना है उसका वर्णन सरल व स्पष्ट शब्दों में करें। इस प्रकार के अनुबंध पर दोनों पक्षों के हस्ताक्षर होना चाहिए। साधारणतया इस प्रकार के अनुबंध की दो प्रतियां तैयार की जाती हैं और दोनों पक्ष एक-एक प्रति अपने पास रखते हैं। अनुबंध की ऐसी दोनों प्रतियों पर दोनों पक्षकार के हस्ताक्षर होने चाहिए और दोनों प्रतियां एक समान होनी चाहिए। इनका प्रमाणीकरण (Attestation) सामान्य नियमों के अधीन किया जाना चाहिए।
 
3. अनुबंध (Agreement) की भाषा क्या होनी चाहिए?
 
अनुबंध की भाषा हिंदी, अंग्रेजी अथवा राज्य की स्थानीय भाषा हो सकती है, जिसे दोनों पक्षकार आसानी से पढ़ व समझ सकें।

4. अनुबंध (Agreement) की स्टाम्प ड्यूटी क्या है?

अनुबंधों पर स्टाम्प ड्यूटी की दर अलग-अलग राज्यों (States) में अलग-अलग होती है। विभिन्न राज्यों में स्टाम्प ड्यूटी अलग-अलग है। हर राज्य ने इंडियन स्टाम्प एक्ट के स्थानीय संशोधन करके अलग-अलग कोटि के अनुबंधों के लिए अलग-अलग स्टाम्प ड्यूटी निर्धारित की है। अतः कोई भी अनुबंध तैयार करने के पहले अनुबंध पर देय स्टाम्प ड्यूटी की जानकारी प्राप्त कर लेनी चाहिए।
 
5. क्या अनुबंध (Agreement) का रजिस्ट्रेशन आवश्यक है?

अनुबंधों के रजिस्ट्रेशन के सम्बन्ध में सामान्य नियम है कि यदि कोई अनुबंध किसी अचल संपत्ति (Immovable Property) में हित उत्पन्न नहीं करता है तो ऐसे अनुबंध का रजिस्ट्रेशन अनिवार्य नहीं है किन्तु यदि वह अचल संपत्ति में हित उत्पन्न करता है तो उसका रजिस्ट्रेशन अनिवार्य होगा।

आप सभी ने Affidavit का नाम अवश्य सुना होगा। हम सभी को अपने जीवन में कभी न कभी Affidavit बनवाने की आवश्यकता अवश्य पड़ती है। किन्तु Affidavit के बारे में सम्पूर्ण जानकारी हममें से कुछ ही लोगों को होती है। तो आइये इस लेख के माध्यम से Affidavit के बारे में निम्नलिखित महत्त्वपूर्ण बातें समझते हैं -

1. एफिडेविट (Affidavit) क्या होता है?

जब कोई व्यक्ति किसी कार्य को करने या न करने की लिखित रूप में स्वेच्छा से तथ्यात्मक घोषणा करता है तो इस लिखित घोषणा को Affidavit कहते हैं। Affidavit को हिंदी में शपथ-पत्र भी कहते हैं। इसे हलफनामा भी कहा जाता है।

2. एफिडेविट कितने प्रकार के होते हैं?
 

सामान्यतया एफिडेविट दो प्रकार के होते हैं- पहला वह होता है जो हम किसी सरकारी, गैर सरकारी ऑफिस,  अर्द्धन्यायिक संस्था या विद्यालय आदि में शपथ के रूप में देते हैं। दूसरा वह होता है जो हम कोर्ट में देते हैं। कोर्ट में दिया जाने वाला एफिडेविट साधारण एफिडेविट जैसा ही होता है किन्तु इसके ऊपर कोर्ट का नाम लिखा हुआ होता है। इसको नये केस, जवाबदावा या एप्लीकेशन के समर्थन में या गवाही के रूप में कोर्ट में दिया जाता है। 
 
3. एफिडेविट का उद्देश्य क्या है? 

एफिडेविट एक दस्तावेज है जिसके माध्यम से हम अपनी बात को सशपथ कहते हैं। जब कोई व्यक्ति एफिडेविट देता है तो इसका सीधा तात्पर्य यह है कि शपथकर्ता जो भी कह रहा है, वह अपनी खुद की मर्जी से कह रहा है और उसके द्वारा कहा गया कथन बिलकुल सत्य है। 

4. एफिडेविट का प्रयोग कहाँ होता है?

ऐफिडेविट का इस्तेमाल कोर्ट में भी हो सकता है और
सरकारी, गैर सरकारी ऑफिस,  अर्द्धन्यायिक संस्था या विद्यालय आदि में भी। जन्म प्रमाणपत्र से लेकर विवाह के प्रमाणपत्र तक हर जगह एफिडेविट की आवश्यकता पड़ती है।

5. एफिडेविट कैसे बनवाएं?
 
एफिडेविट बनवाने के लिए सबसे पहले आपको ऊपर शीर्षक लिखना होता है, जिस सम्बन्ध में आप एफिडेविट बनवा रहे हैं। जैसे यदि आप अपने पुत्र के जन्म दिनांक के सम्बन्ध में एफिडेविट दे रहे हैं तो उसके लिए सबसे पहले आपको उसके ऊपर लिखना होगा जन्म दिनांक हेतु शपथपत्र या आप सीधे शपथपत्र भी लिख सकते हैं। उसके बाद आपको उस एफिडेविट में अपना नाम, पता और अपनी आयु (यदि पुत्र नाबालिग है) लिखनी होती है। फिर आपको उस एफिडेविट के अंदर एफिडेविट बनवाने का उद्देश्य लिखना होता है कि आप एफिडेविट क्यों बनवाना चाहते हैं या क्यों बनवा रहे हैं। फिर आप को शपथ लिखनी होती है कि ऊपर बताई गई सारी बातें बिल्कुल सच हैं। फिर आपको उसके नीचे अपने हस्ताक्षर करने होते हैं। हस्ताक्षर करने के बाद आपको आख़िर में अपने एफिडेविट को रजिस्टर करवाना होता है। कोर्ट के एफिडेविट में ऊपर उस कोर्ट का नाम लिखना होता है, जिस कोर्ट में एफिडेविट देना होता है और उस एफिडेविट में आप वही बातें लिखेंगे जो आपको कोर्ट के अंदर बोलना है।

6. एफिडेविट की भाषा क्या होती है?

एफिडेविट हिंदी, इंग्लिश या अपने राज्य की किसी लोकल भाषा में बनवाये सकते हैं। सुप्रीम कोर्ट या हाई कोर्ट में एफिडेविट देना हो तो इंग्लिश भाषा में ही देना होता है। हाँ, विशेष अनुमति पर हाई कोर्ट या सुप्रीम कोर्ट में भी अपने राज्य की लोकल भाषा में एफिडेविट दिया जा सकता है।

7. एफिडेविट के लिए स्टाम्प पेपर और फीस क्या निर्धारित है?

सामान्तया एफिडेविट रूपए 10/- के स्टाम्प पेपर पर बनवाये जाते हैं। किन्तु राज्यों का अपना-अपना Stamp Duty Act होने के कारण यह राशि भिन्न-भिन्न हो सकती है। सामान्तया कोर्ट में दिए जाने वाले एफिडेविट पर जुडिशल स्टाम्प (कोर्ट फीस) का प्रयोग होता है जबकि अन्य स्थानों पर दिए जाने वाले एफिडेविट पर नॉन-जुडिशल स्टाम्प पेपर का प्रयोग किया जाता है। 

8. एफिडेविट को अटेस्ट कहां करवाएं?

एफिडेविट में की गई घोषणा किसी ऐसे व्यक्ति के समक्ष ली जाती है जो विधि द्वारा उसके लिए अधिकृत हो, जैैसे नोटरी पब्लिक या ओथ कमिश्नर। सामान्यतया कोर्ट में दिए जाने वाले एफिडेविट ओथ कमिश्नर से और कोर्ट के बाहर अन्य विभागों को दिए जाने वाले एफिडेविट नोटरी पब्लिक से अटेस्ट करवाए जाते हैं।

9. गलत
एफिडेविट देने के क्या प्रभाव हैं?

गलत तथ्यों पर एफिडेविट देना अपराध की श्रेणी में आता है। यदि कोई व्यक्ति जानबूझकर झूठा बयान देता है तो उसके खिलाफ कानूनी कार्रवाई की जा सकती है। यदि कोई व्यक्ति किसी और के बदले में ऐफिडेविट पर दस्तखत करता है और उसका गलत इस्तेमाल करता है, तो ऐसा करने वाले शख्स के खिलाफ मुकदमा बन सकता है। यदि किसी व्यक्ति द्वारा गलत शपथ-पत्र अदालती कार्रवाई के दौरान पेश किया जाता है, तो अदालत ऐसे व्यक्ति के खिलाफ मुकदमा चलाने का आदेश दे सकती है।

10. गलत
एफिडेविट देने पर क्या सजा हो सकती है?

किसी और व्यक्ति के बदले में ऐफिडेविट पर दस्तखत कर उसका गलत इस्तेमाल करने पर भारतीय दंड संहिता की धारा-419 (पहचान बदलकर धोखा देना) के तहत
3 साल तक की सजा हो सकती है। किसी सरकारी या गैर सरकारी ऑफिस में झूठा सबूत पेश करने के मामले में दोषी पाए जाने पर 3 साल तक की सजा हो सकती है। यदि किसी व्यक्ति द्वारा गलत शपथ-पत्र अदालती कार्रवाई के दौरान पेश किया जाता है, तो उस इंसान को भारतीय दंड संहिता की धारा-193 के तहत अधिकतम 7 साल तक की सजा हो सकती है।

Help to Poor Litigants

The constitution of India postulates a society in which social, economic and legal justice is available to all on the basis that they are equal. To enforce the constitutional mandate of equality before the laws, the State has to ensure access to justice, that is to say, that oppornuties for securing justice are not denial to any citizen by reason of economic or other disability. According to new concept, when a poor litigant is compelled to contest the case against a rich person, he should not only be given financial legal aid but the poor downtrodden person should also be furnished aid with advice and assistance in settlement of disputes by negotiation, concilliation, compromise, arbitration or any other means. This could be possible only when we change our outlook and re-orient our thinking process and then the theme of social justice be able to change the fate of the poor litigants.

The Constitution of India furnishes equality before law and equal protection of laws, irrespective of any caste, race, religion, wealth or status.In India, various legal provisions relating to free legal aid are available for the help of poor litigants.

(A) CONSTITUTIONAL: Preamble of the Constitution of India aims at giving justice social, economical and political to every citizen of India. If the fundamental rights, sanctioned wider Articles 14, 19 and 21, provided in favour of the citizens of India are violated, the constitutional remedies are meaningless until and unless the poor litigant is not provided with proper help. 42nd Amendment of the Constitution of India inserted Article 39-A, providing for social justice and free legal aid for the poor litigants. In the same way, Article 51-A was inserted, which enshrines a sacred fundamental duty in the sphere of aid and advice to the poor and downtrodden litigants.

(B) OTHER LAWS:1. There are provisions in the Advocate Act, 1966 , which are helpful for encouraging free legal aid to poor litigants.
2. In the prosecutions under section 302 I.P.C., the poor accused persons are allowed free defence counsels.
3. In Motor Vehicle Act accident claim petition, a poor litigant is entitled to get free legal aid.
4. In the Consumer Protection Act complaint, no Court fee is levied.
5. Order 33 of Civil Procedure Code allows to file the suits by indigent persons without paying any prescribed Court fee.
6. Similar provisions are there for the appeals by indigent/ poor litigants.
7. Order 33 Rule 18 of Civil procedure Code provides that the subject of the provisions of this Order, the Central Government or State Government was empowered to make supplementary provisions providing free legal services to indigent persons.
8. Various States have passed their Legal Aid Rules in this regard for providing the free legal aid, advice and support to poor/ indigent litigants.
9. Some Universities have also shown their interests to implement legal aid scheme.
Great Hope that the State Government, Universities, District Collector, Bar Associations, Social Workers, Political Parties, N.G.O.s and Rich Persons should come forward to help the needy downtrodden litigants in the Courts.

These awareness may make happy to the poor and downtrodden litigants and thus the goal of socio-economic justice may be achieved.

Child Labour in India

In India, there are several temples of ‘Bal Krishna’, ‘Bal Hanuman’ ie Child God. According to Hindu philosphy, a child is considered to be form of God. India is better known to be the country of Dhruv, Prahlad, Lav-Kush and Abhimanyu, the children having talents wisdom, intelligency and warriership.

Apart from this, present day picture of poor Indian child is very dark. The poor child is the most neglected, most exploited and the most abused. Female child is the most deprived and under privileged of the whole class of such children. The girls are not only withdrawn from schools and forced to indulge in child labour but they are even dragged in the prostitution.

Child labour is violation of human rights and is considered to be a ‘necessary evil’ in a poor country like India. It hampers their normal and natural physical, mental, spritual, intellectual, emotional, moral and social development.

Children are doing work as domestic servants. They are employed in hotels, workshops, service stations, shops, construction sites and pulling rickshaws etc. They are even working in hazardous and unhygienic forms of labour in manufacturing factories.

Article 24 of the Constitution of India, 1950 says, “No child below the age of fourteen years shall be employed to work in any factory or mine or employed in any hazardous employment”.

Indian legislature has also enacted the Factories Act, 1948 , The Children Act, 1960, The Child Labour (Prohibition and Regulation) Act, 1986 etc. for the protection of rights of children. Article 45 of the Constitution of India, 1950 casts duty on the State to pendeavour to provide free and compulsory education to the children. Article 25(2) of the Universal Declaration of Human Rights also states about the special care and assistance for the motherhood and children.

For the past few years, work done by the Government of India and the States Government in this issue is praiseworthy. Many new schemes and policies are introduced for the education and betterment of the children. But, this problem is still in existence in India even though all these policies are available in India.

There may no other opinion that child labour should be restricted and if possible completely vanished. It is a socio-economic national problem, which requires close analysis and practical solutions to meet with this burning question.
